General conditions
Acceptance of the RESERVATION TERMS AND CONDITIONS is mandatory for guests making reservations with us.
CANCELLATION
In the event that the client wishes to cancel the reservation for any reason, he will be entitled to a full refund of the amount paid, subject to deduction of cancellation fees. Cancellation charges are based on the total rental price and calculated from the date the rental period begins.
In case of cancellation, the following conditions will apply:
If the cancellation occurs 30 days before the date of entry, it will be penalized with 0% of the rental payment for the following apartments: Fuenterrabía, Txingudi, Hondarribia, Guadalupe, Villa Carmen and Akartegi.
If the cancellation occurs 20 days before the date of entry, it will be penalized with 0% of the rental payment for the following apartments: Ama Guadalupekoa, Villa Elisa, Jaizkibel.
For the rest of the apartments there is free cancellation if it occurs 15 days before the date of entry into the apartment.
In case of no-show, the tourist will lose 100% of the rental payment.
There will be no payments if the client voluntarily withdraws from the services before completing their stay.
STAYS
Basquelidays Rentals SL (trade name "Basquelidays") with advertisements for apartments ('properties') on websites certifies that all properties have been personally inspected by the company to ensure that they meet our standards. At the time of publication, the properties are furnished and equipped as described in the detailed descriptions to guests ('Clients') on the company's website.
Occasionally, the owners may change the layout of the apartment, furniture or accessories. The company will try to make relevant updates to the website as soon as possible and will notify guests in the event that changes to the property change the nature of the accommodation.
Differences between the description and photos on the website and the features actually found in the property do not constitute a basis for cancellation, refunds or other claims against the company.
The prices and seasons published on the company's website are indicative and are subject to variations without prior notice, before the reservation is confirmed. The confirmation of the reservation will become effective once the prepayment or full payment of the reservation has been made. The reference currency is Euro € and all apartment ads appear in this currency.
PAYMENTS
The reservation will not be confirmed until the client receives an express confirmation from the company. A prepayment of 30% of the rental price will be paid on reservation and confirmation will not be made until the full advance payment has been received. The company will not send any confirmation in the event that the prepayment is not received or does not occur. In this case the property can be assigned to another client.
The remaining balance of the rental must be paid between 2 months and the time of check-in. The lack of this last payment will constitute a basis for cancellation and the property will be put up for rent again and the cancellation conditions will be applied.
Payment by credit card is not subject to any type of commission by the company. Payments may also be made, without surcharge, by direct debit in the company's bank account.
SUBSTITUTE ACCOMMODATION
If, as a result of a serious breakdown or failures in the rented property, if Basquelidays decides that it is not possible to continue with the reservation, the company will do everything possible to find a replacement property acceptable to the client, or refund any money paid in the unused rent. The client acknowledges that in this case, the company's liability for damages will be limited to the amount of unused rental, based on a pro-rata calculation of unused rental days. Should a property become unusable prior to a client's arrival, the company will make every effort to find a suitable replacement property of a similar standard. In the event that said property has a higher price, clients will have the option to pay the difference or receive a full refund of the money paid.
ARRIVAL PROCEDURE
After the final payment, clients will receive a receipt from the accommodation including the payment made and the instructions to follow upon arrival. In the weeks or days prior to the arrival date, the company will request the following details via email or telephone: estimated time of arrival and additional requirements. Basquelidays will make every effort to accommodate accommodations outside of normal hours.
The reservation receipt is not transferable. The client acknowledges that the following circumstances provide the owner or the company with a valid basis for the immediate termination of the rental agreement, without possible recourse by the client to be reimbursed or reaccommodated:
- Exceed the maximum number of guests indicated in the reservation.
- Inappropriate conduct on the property (including arbitrary destruction of property, lack of hygiene, excessive noise, disturbance to the neighborhood, etc.)
- Celebrations of parties, weddings, or other unauthorized celebrations or that involve stays of people other than guests.
- The client acknowledges that there will be no recourse against the company or the owner in the event that any of these events cause the premature termination of the rental.
DEPARTURE AND CLEANING
Standard check out time is until 10:00 am. hours (in some properties it may vary). It is a condition of the rental that the property must be left in a clean and tidy manner at the end of the rental period.
Upon arrival we may pre-authorize a debit/credit card of your choice (it may be different from the one you made the initial payment to guarantee the reservation) as a deposit to insure against any potential damage that may be caused during your stay. We reserve the right to make the appropriate deduction from the card in the event of any damage to the accommodation or its contents that has been caused, or in the case of a late check-out after 10:00 am on the day of your departure.
COMPLAINTS AND CLAIMS
Any problems that the client encounters with the property during the rental period must be immediately reported to the company. The company promises to deal with problems and resolve them to customer satisfaction as soon as possible. A reasonable period of time must be granted for the company to resolve the problem. The abandonment of the property will nullify the right to claim compensation.
When a client determines that he is entitled to a claim for compensation, should this have taken place, the compensation period will start from the time the claim is received until the end of the rental period. Compensation requests must be submitted to the company in writing (info@basquelidays.com) within 48 hours prior to the end of the rental period or during your stay.
The following scenarios will not give rise to claims:
- Force majeure, terrorist acts or natural disasters
- Shortage of electricity, internet, gas or water beyond the control of property owners
- Damage caused by wind, rain, hail, floods, fire, lightning, landslides or other acts of God
- Claims arising as a result of damage caused by clients to the property.
- Differences in descriptions and photographs of the property that appear in the promotional material (unless it significantly alters the nature of the accommodation)
- Damage or loss of belongings or property of Clients
- Civil works or construction projects near the rental property that are not under the control of the company
LIMITATIONS OF LIABILITY
Clients acknowledge that they are responsible for taking all necessary safety precautions for themselves and their guests. Basquelidays does not accept any responsibility for accidents that may cause death, illness or bodily harm regardless of their cause. The company and owners deny any responsibility or claims in case of incidents that occur while the occupants or guests are under the influence of alcohol or any type of non-therapeutic drug. The limitation of liability for any claim against the Company and the property owners, whatever the cause, is limited to the total amount of rent paid to the company by the Client.
ACCEPTANCE OF THE TERMS AND CONDITIONS
Clients acknowledge that by accepting these terms and conditions in the company's reservation request or inquiry forms they will be bound by the provisions contained therein and accept responsibility for damages caused by them or their parties to the Owners. This contract will be governed by its own clauses and in those that are not provided for in them, the parties will abide by the provisions of the commercial and civil laws of the Spanish legal system.
